The Fundsz settlement details involving the estate of Rene Larralde and Juan Pablo Valcarce became public after court approval. The court approved both settlements on July 30, 2026. The settlements address allegations made in the CFTC’s original Fundsz complaint. Both defendants acknowledged violations of the Commodity Exchange Act.
Rene Larralde died on September 6, 2023, and his wife, Rachel Larralde, represents his estate. Under the settlement, the estate will surrender the former Larralde Residence in Rockledge, Florida. It will also surrender $30,836 in cash, $4.1 million from a Bank of America joint account, and $2.67 million in cryptocurrency. A Ford Expedition and $3,584 previously seized by the Fundsz receiver will be returned to Rachel Larralde.
The Juan Pablo Valcarce Fundsz settlement includes a permanent injunction. The order prevents Valcarce from participating in the sale of commodities and commodity interests. It also prohibits further consumer fraud. The settlement states that Valcarce received $69,135 as a Fundsz employee. However, he does not face a monetary payment under the settlement.
Fundsz was an MLM cryptocurrency scheme launched by Rene Larralde in 2020. After the scheme collapsed, the CFTC filed its complaint in August 2023. Brian Early and Alisha Ann Kingrey remain defendants in the case. Neither has filed an answer to the CFTC complaint. On August 18, 2026, the CFTC filed a motion seeking default judgment against both defendants. The Fundsz legal case therefore remains active.
